Social Security Disability While you can file a disability application/claim without an attorney with the assistance of Social Security Field Office staff, the person taking your claim for SSD and SSI benefits will not be able tell you how to fill out the various forms in a way that maximizes your chances of being awarded benefits. Social Security employees are not permitted to provide any help that could be construed as legal advice. Furthermore, the Social Security Administration does not provide clear information within their various written materials available at their field offices and online. Statistically, approximately sixty-five percent of all 2006 initial claims nationwide were denied according to the Social Security Administration's Disability Research File maintained by the Office of Disability Programs. One reason for this high denial rate is that most people are not represented at the initial application level, and, thus, needlessly harm their chances by improperly filling out the required forms. If you suffer from physical and/or mental impairments, and are considering filing a disability claim, or have initiated or been denied a claim for benefits, contacting our office may be one of your most important and best decisions! John J. Balkunas, Jr., Esq. is a former Vermont Disability Claims Adjudicator who adjudicated Social Security, SSI, and Medicaid Disability claims for the Social Security Administration.
