Whether you are buying or selling a commercial, first home, second home, vacation home, or an investment property, the purchase or sale of real estate can involve significant monies.  It consequently makes sense to confer with and retain an attorney to represent your interests.

Our office assists businesses and individual homeowners with the process of buying and selling properties, as well as with the various ownership issues that can arise after the sale.  Buying and selling real estate is complicated; we can explain the process and the options that may be available, look out for your interests, ensure title to the property is clear, and take care of issues that may arise following the closing.

A real estate attorney’s work often starts with the purchase and sale agreement.  Often realtors provide these, thus making it imperative that an attorney review them as soon as possible.  If the purchaser or seller waits too long for a purchase agreement to be reviewed, the right to insist that certain changes be made pertaining to overlooked issues could be lost.  It is essential that appropriate clauses are included and contingencies addressed.

  • Obtain a title search and/or title insurance binder, review the status of the title, and require the seller to correct any defects in the title;
  • Prepare or review the deed, any mortgages, other closing documents and any necessary bill of sales to cover personal property included in the sale;
  • Advise the buyers how title should be taken (joint tenancy, tenancy in common, etc.) and how this decision will affect the buyers in the future; and
  • Address issues that are not covered by title insurance or a title examination, such as zoning ordinances and other land-use restrictions, and liens, including water, sewer and special assessment liens.

At the closing, we will review and explain the various documents involved and make sure that all steps are taken to fulfill the intent of the parties as expressed in the purchase agreement.  We will also make sure that all of the steps necessary for the buyers to obtain clear, marketable title are taken, including the recording of the deed and other necessary documents.
