Landlord-Tenant

Under Vermont law, a landlord of a residential property must comply with 9 V.S.A. Sections 4451-4469, the Residential Rental Agreements Act, 12 V.S.A. Sections 4761-4859, and the applicable Vermont Rules of Civil Procedure in order to regain possession.  If a landlord violates the applicable statutes and rules with respect to termination of the lease, abandonment, or trespass, the tenant may have a right to recover damages and reasonable attorney’s fees.

While commercial evictions are somewhat more liberal, and allow self-help in some instances, there are certain legal issues that must be considered before acting.  Self-help ejectment must be commercially reasonable, and provided for in the lease.  Given the risk of significant damage to a tenant’s business and tenant’s employees, this type of eviction should rarely be done without first consulting an experienced landlord-tenant attorney familiar with the area of law and attendant issues involved.
