Bankruptcy

Bankruptcy is a legally asserted inability or impairment of ability of an individual or organization to pay their creditors.  Creditors may file a petition against a debtor (“involuntary bankruptcy”); however, a majority of cases begin by a debtor filing a petition (“voluntary bankruptcy”).

Although and individual or business is permitted to perform certain actions (i.e., file motions, objections, claims, appearances, etc.) in a bankruptcy proceeding, these actions may not necessarily be wise choices.  The best chance of optimizing any bankruptcy proceeding, whether as debtor or creditor, is to use the assistance of knowledgeable and experienced bankruptcy counsel.  For example, unlike most other areas of law where a "good reason" can sometimes be sufficient grounds for a court to allow a late filing, the Bankruptcy Court has no authority to waive filing deadlines in many instances no matter what the reason.  The primary reason for the harshness is the Bankruptcy Code's purported desire to provide debtors with a “fresh start.”
